This Privacy Policy is incorporated by this reference into the Code Ocean, Inc. Terms of Use  (“ TOU ”).  All other terms not defined in this Privacy Policy will have the meanings set forth in the TOU.  The terms “ Code Ocean ,” “ we ,” “ us ,” and “ our ” include Code Ocean, Inc. and our affiliates and subsidiaries.  This Privacy Policy applies to our website located at  (“ Site ”).  This Privacy Policy explains how Code Ocean may collect, use, and disclose information we obtain through the Site.  


Registration.   We collect the information that you provide to us when you register an Account with us, such as your name, email address and certain other information requested on the registration page.

Social Sign-On.   We may collect information from your social media accounts when you use your social media credentials to log in to the Site, such as your name and email address, in accordance with your social media account settings.  

Using the Site.   We collect information about your use of the Site.  For example, we collect information about any User Content that you Post on the Site, Code that you view or share to External Sites and any links that you click on the Site (including links to Publisher websites).  Additionally, we collect certain other information that you provide, such as certain employment and professional information, when you Publish Code.  The information described in this paragraph is known as “ Usage Information ” in this Privacy Policy.  

Making Payments.  If you make a purchase on the Site, then our payment processor will process your payment information.  We do not collect or store any payment information.

Information from Third Parties.   We may obtain information about you from third parties, such as data repositories, universities and Publishers, including your name and email address.  We may combine that information with the information that we collect about you on the Site, including Usage Information.

Customer Support.   We collect information that you provide to us through your communications with our customer-support team.  

Cookies, Automatic Data Collection, and Related Technologies.   The Site collects and stores information that is generated automatically as you use it.

When you visit the Site, we and our third party service providers receive and record information on our server logs from your browser, and from cookies and similar technology.  Cookies are small text files placed on your computer when you visit a website.  The information collected in this manner may include, for example, IP address, browser characteristics, device IDs and characteristics, operating system version, language preferences, referring URLs, and information about the usage of our Site.  Our service providers may collect information about your online activities over time and across different online services   if those online services also use the same service providers.  For instance, we may use Google Analytics.  To learn more about Google Analytics and how to opt out, please visit .  Most browsers allow you to block and delete cookies.  However, if you do that, then the Site may not work properly.

By using the Site, you are authorizing us to gather, parse, and retain data related to the provision of the Site.


Internal and Site-Related Usage.   We may use and retain any information that we collect to provide, maintain and improve the Site and our products and services and to otherwise conduct our business.  

Communications.   We use your information to communicate with you, including to provide you with updates about Code Ocean and/or the Site and for operational purposes, such as account management, customer service, or system maintenance.  

Aggregate Data.   We may de-identify and aggregate data collected through the Site and use it for any lawful purpose.


We Use Vendors and Service Providers.   We may share any information that we receive through the Site with vendors and service providers retained in connection with the provision of the Site, including for data analytics purposes.  We require our vendors and service providers by contract to only use or disclose the information they process on our behalf as necessary to perform certain services on our behalf or comply with legal requirements.

Members of our group.   We may share your information with any members of our group, which includes our affiliates, subsidiaries and branch offices, to which it is reasonably necessary or desirable for us to disclose your information in order to carry out the above-mentioned information processing purposes.

Social Networking Websites.   The Site may allow you to export and share information to social media websites.  We do not share your information with these sites unless you direct the Site to do so.  Their use of any information that you share with them will be governed by their privacy policies, and you may be able to modify your privacy settings on their website.

User Content .  We will disclose your User Content to other Users when you facilitate such disclosures through the functionality available on the Site.  For example, we will disclose to other Users your Software Content and other User Content when you Publish.

Usage Information .  We may share de-identified Usage Information with third parties, such as Publishers, investors, universities and readers of publications that we may publish about Site usage.

Advertising Partners .  We do not rent, sell, or share personal information (as defined by California Civil Code § 1798.83, including information defined as “personal data” under EU data protection law) with other people or nonaffiliated companies for their direct marketing purposes, unless we have your permission.  

As Required By Law and Similar Disclosures .  We may access, preserve, and disclose your information, if we believe doing so is required or appropriate to: (i) comply with law enforcement requests and legal process, such as a court order or subpoena; (ii) enforce this Privacy Policy or the TOU; (iii) respond to your requests; or (iv) protect your, our or others’ rights, property, or safety.

Merger, Sale, or Other Asset Transfers.   If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of assets, or transition of service to another provider, then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.  The use of your information following any of the foregoing events will be governed by the provisions of the Privacy Policy in effect at the time such information was collected by Code Ocean.

With Your Consent .  We may also disclose your information with your permission.


We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy.  Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us.  We do not accept liability for unintentional disclosure.


We do not knowingly collect, maintain, or use personal information, as defined by the Federal Trade Commission’s Children’s Online Privacy Protection Act Rule and including information defined as “personal data” under EU data protection law, from children under 13 years of age, and no part of the Site is directed to children under the age of 13.  If you learn that your child has provided us with personal information without your consent, you may alert us at .  If we learn that we have collected any personal information from children under 13, then we will promptly take steps to delete such information.


We may transfer your information to recipients in countries other than the country in which your information was originally collected.  These countries include the United Sates, where we are headquartered and where some of our service providers process and host your information.  The laws in those countries may not offer the same level of data protection as the country in which the information was initially provided.  When we transfer your information to recipients in other countries, we will protect the information as described in this policy.

If you visit the Site from the European Economic Area (“ EEA ”) or other regions with laws governing data collection and use, then please note that you are agreeing to the transfer of your information to the United States and processing globally.  By providing your information to the Site, you consent to any transfer and processing in accordance with this Policy.

Opt-out.  You can unsubscribe from promotional emails from us via the unsubscribe link provided in the email.  Even if you opt out from receiving promotional messages from us, you will continue to receive administrative messages from us.  

EEA users.   If you are located in the EEA, you may also have the right under applicable law to request access to and receive information about the information we maintain about you, update and correct inaccuracies in your information, have the information blocked or deleted, and object at any time to or withdraw your consent to our processing of your information.  These rights may be limited in some circumstances by local law requirements.  You can exercise your rights by contacting us at the below contact information.  Note however that if you exercise your right of blocking or deletion, if you decline to share certain information with us, or if you withdraw your consent, we may not be able to provide to you some of the features and functionalities of the Site.


Posting of Revised Privacy Policy.   We will post any adjustments to the Privacy Policy on the Site, and update the “Effective Date” above.  We will post a prominent notice on our Site to notify you of any significant changes to our Privacy Notice.  If you are concerned about how your information is used, then bookmark the applicable page on the Site and read this Privacy Policy periodically.  Your continued use of the Site after changes to the Privacy Policy constitutes your acceptance of the new terms of the Privacy Policy.

New Uses of Information.   From time-to-time, we may desire to use information for uses not previously disclosed in our Privacy Policy.  If our practices change regarding previously collected information in a way that would be materially less restrictive than stated in the version of this Privacy Policy in effect at the time we collected the information, then we will make reasonable efforts to provide notice and obtain consent to any such uses as may be required by law.
